As of April 14, 2003, we are required under the Health Insurance Portability and Accountability Act (HIPAA) law to maintain the privacy of your health information, and to provide you with this Notice of Privacy Rights & Practices.
Your acknowledgement of receipt and of your understanding of this information will be required the first time you receive services after with D.r Roger Libby.
You have the right to have information you share with Dr. Roger Libby held in strict confidence. When DR. Libby sees a couple, he respects the confidentiality of each person. He will not repeat anything he is asked not to disclose. Dr. Libby follows HIPAA guidelines to assure your privacy and confidentiality. Except for the following exceptions, I will not discuss you with anyone without your written permission.
1. Suspected child abuse or dependent adult or elder abuse, for which I am required by law to report to appropriate authorities.
2. If a client threatens serious bodily harm to another, I must notify the police and inform the intended victim.
3. If a client intends to harm him/herself, I will enlist their cooperation to ensure their safety. If they do not cooperate, I will take further measures without their permission that are provided to me by law in order to ensure that they are safe.
The Washington State Licensing Department requires that you be informed of the following: “Counselors practicing counseling for a fee must be credentialed with the Department of Health for the protection of the public health and safety. Credentialing of an individual with the department does not include recognition of any practice standards, nor necessarily implies the effectiveness of any treatment.”
As a client, you have the right to choose a counselor and treatment approach that suits your needs, and you have the right to complete knowledge of your counselor’s qualifications, license and training.
Dr. Libby is required by law to keep sessions notes for five years. These are confidential records. I will assure your privacy and confidentiality.
FOR MORE INFORMATION: If you would like further information about your privacy rights, are concerned that we have violated your privacy rights or disagree with a decision that we made about access to your PHI, you may contact us at the address or phone number below. You may also file written complaints with the Director, Office for Civil Rights of the U.S. Department of Health and Human Services. Upon request, we will provide you with the correct address. We will not retaliate against you if you file a complaint with us or with the Department.
